Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Last Minute mobile application and related services (the "Service"), provided by Fatima Rizvi ("Last Minute," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility

You must be at least 18 years old and legally capable of entering a binding agreement to use the Service. By using the Service, you represent that you meet these requirements and that the information you provide is accurate and current.

The Service

Last Minute provides tools that may help parents and helpers create profiles, communicate availability, and facilitate potential childcare connections. Features may be incomplete, change during development, or be removed.

Last Minute is a technology platform, not a childcare provider, employer, staffing agency, or emergency service. We do not employ users, supervise childcare, control user conduct, guarantee availability or suitability, or make promises about the identity, background, qualifications, licensing, insurance, or conduct of any user unless expressly stated in the Service.

User responsibility and safety

You are responsible for evaluating other users, confirming identity and qualifications, conducting any appropriate interviews, reference or background checks, agreeing on compensation and responsibilities, and deciding whether an arrangement is safe and appropriate. Do not rely on the Service for emergencies. For an emergency, contact local emergency services.

You must comply with applicable childcare, employment, tax, licensing, safety, and other laws. Users are responsible for their own interactions, agreements, payments, taxes, insurance, and disputes.

Accounts and security

You must provide accurate account information, protect your credentials and devices, and promptly notify us of suspected unauthorized access. You are responsible for activity under your account to the extent permitted by law. You may not create an account for another person without authorization or use another person's account.

Phone and email authentication

If you request an email verification message or one-time SMS code, you authorize us and our providers to send the requested transactional authentication message. Message and data rates may apply. Authentication messages are not marketing subscriptions. You must provide a phone number or email address you control or are authorized to use.

Acceptable use

You may not:

• Use the Service unlawfully, fraudulently, deceptively, or to harm, exploit, harass, or endanger another person.
• Provide false identity, qualification, availability, verification, or profile information.
• Post content that is illegal, threatening, discriminatory, infringing, sexually exploitative, or invasive of privacy.
• Attempt to access another user's account or data, bypass security controls, scrape the Service, introduce malicious code, disrupt operations, or reverse engineer the Service except where law expressly permits it.
• Use the Service to send unsolicited marketing, spam, or unauthorized communications.

User content

You retain ownership of information and content you submit. You grant us a limited, nonexclusive, worldwide license to host, store, reproduce, format, and display that content only as reasonably necessary to operate, secure, and improve the Service. You represent that you have the rights needed to submit the content and that it does not violate law or another person's rights.

Privacy

Our Privacy Policy explains how we collect, use, and disclose information and is incorporated into these Terms.

Service changes and availability

We may modify, suspend, limit, or discontinue all or part of the Service. We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free. During development, data or features may change, subject to applicable law and our Privacy Policy.

Suspension and termination

You may stop using the Service at any time. You may request account deletion by contacting sfrizvi6@gmail.com. We may suspend or terminate access when reasonably necessary to protect users or the Service, investigate suspected violations, comply with law, or enforce these Terms. Provisions that by their nature should survive termination will survive.

Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available." We disclaim warranties of merchantability, fitness for a particular purpose, title, noninfringement, and any warranties arising from course of dealing or usage. We do not warrant or endorse users, childcare arrangements, user content, or outcomes.

Limitation of liability

To the fullest extent permitted by law, Last Minute and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of data, profits, goodwill, or opportunities, or harm arising from interactions or arrangements between users. Our aggregate liability for claims relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim or 100 US dollars. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Last Minute and its operator from claims, damages, losses, and expenses arising from your misuse of the Service, your content, your violation of these Terms or law, or your interactions and arrangements with other users.

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Courts located in Santa Clara County, California will have exclusive jurisdiction over disputes, except where applicable consumer law gives you the right to bring a claim elsewhere.

Changes to these Terms

We may update these Terms as the Service changes. We will post revised Terms here and update the effective date. If a change is material, we will provide any additional notice required by law. Continued use after updated Terms take effect constitutes acceptance where permitted by law.
